Cold calling and its consequences

Cold calling can be punished in Austria with fines of up to €37,000 (in words: thirty-seven thousand euros).

Dear cold callers, including those from neighbouring Germany: Cold calling is prohibited in Austria and can result in fines of up to €37,000.

 

The Telecommunications Act 2003 (TKG) already prohibits, in the original version of Section 107(1), calling people for advertising purposes without their prior consent. BGBl. I No. 23/2011 added a new paragraph 1a, which also prohibits callers from suppressing or falsifying their phone number display when making phone calls for advertising purposes. A violation of these provisions can be punished with a fine of up to €37,000 pursuant to Section 109(3)(19a).", Quote from Ing. Mag. Wolfgang Höglinger, Manz (see link below).

UPDATE, 02.03.2026:

According to information from partner Simon Pöschl of the law firm AWZ, penalties of up to EUR 100,000 are now possible for cold calling (Section 187(6)(9) in conjunction with Section 174(1) TKG 2021) and up to EUR 50,000 for cold mailing.
